The nanny for Puff Daddy's twin daughters is suing their mother for abuse and failure to pay overtime.

Dawn Drago, the former nanny for rapper Sean "Diddy" Combs' twin daughters, has filed a lawsuit against their mother, Kim Porter and Combs' company, Bad Boy Worldwide Entertainment Group for battery and wrongful termination.

According to Drago,  she was originally hired her as a personal chef.  However, after Porter fired their previous nanny, Drago became the chef, house manager and full-time nanny for the twin daughters.  Drago says Porter subjected her to relentless verbal abuse.  "This abuse culminated in Porter physically and violently shoving Ms. Drago into a door frame while she was working, causing Ms. Drago severe bruising and fear."

In addition, Drago claims Porter required her to spend the night 2 times a week but,  did not pay her for work between the hours of 10 p.m. and 5:30 a.m.

Porter allegedly terminated her for taking a previously approved vacation to care for her sick father, according to Drago.

Sean Combs was not named as an individual defendant in the lawsuit, which also alleged infliction of emotional distress, failure to overtime wages and failure to provide meal and rest periods.

If these allegations are found to be true than  Porter would be in violation of both State and Federal employment laws.  Seen below:

Overtime Pay:

In California an employee is eligible for overtime pay once they have worked 8 hours in a day, even if they do not work more than 40 hours in a week.  An employee is entitled to a 50% premium for every overtime hour worked. An employee must be paid time and a half or 150% of their regular rate of pay.

Hostile Work Environment:

According to Employment Law, a hostile work environment exists when an employee experiences workplace harassment and fears going to work because of the offensive, intimidating, or oppressive atmosphere generated by the harasser, or in the case the employer.

If you have experienced wrongful termination, harassment or discrimination please call California Employment Attorney, Todd M. Friedman for a free consultation.
