Former Image Dry Cleaner and Laundry, Inc., employee, David Greer has filed a lawsuit against the company claiming he was not properly paid for overtime work in violation of the Fair Labor Standards Act. (Case No. 4:11-cv-00827) According to Greer, during his employment, he was improperly classified and paid as an exempt employee. Many companies do this to avoid having to pay their employees overtime. And if Greer’s accusations are true, Image Dry Cleaner was not different. He was not paid overtime at the required rate of one and one-half times his regular rate of pay for hours worked in excess of 40 hours each week. Greer states that during his employment, he worked an average of 15 hours of overtime each week. He reportedly alerted the president of the company about his situation and was terminated immediately. Greer is asking for an award of unpaid overtime compensation, liquidated damages, back pay and lost benefits, front pay and lost benefits, interest, court costs, and attorney’s fees. Greer is also asking the Court for reinstatement to the position and pay grade which he previously held.
